Digital Millennium Copyright Act (DMCA) Policy

1. Introduction to our Copyright Policy

Transcriptafy ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our service that are reported to our Designated Copyright Agent identified below.

It is important to understand that Transcriptafy is a utility tool that programmatically extracts closed caption text and metadata that has been made publicly available on YouTube. We do not host, store, or distribute video files. Transcripts cached on our servers are temporary and are directly mapped to the public accessibility status of the underlying YouTube video. If a video is removed from YouTube, the transcript simultaneously becomes inaccessible through our platform.

However, if you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, you may report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement.

2. Submitting a DMCA Notice of Alleged Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify Transcriptafy's copyright agent, as set forth in the Digital Millennium Copyright Act of 1998 (DMCA). For your complaint to be valid under the DMCA, you must provide the following information in writing:

  • Physical or Electronic Signature: An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the Copyrighted Work: Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific Transcriptafy URL).
  • Contact Information: Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
  • Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

3. Processing Timeline and Actions Taken

Upon receipt of a valid DMCA Notice containing the required information outlined above, Transcriptafy will take the following actions:

  1. Review: Our legal team will review the notice for completeness and validity within 24 to 48 business hours.
  2. Action: If the notice is deemed valid, we will expeditiously remove or disable access to the allegedly infringing material (e.g., the specific transcript URL on our platform).
  3. Notification: We will take reasonable steps to promptly notify the user who generated or requested the extraction of the transcript (if identifying information is available) that we have removed or disabled access to the material.

4. Counter-Notification Process

If you believe that your material was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a Counter-Notice must be a written communication provided to our Designated Agent that includes substantially the following:

  • Physical or Electronic Signature: Your physical or electronic signature.
  • Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Statement of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact Information & Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Transcriptafy may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid Counter-Notice, Transcriptafy will promptly forward a copy to the person who provided the original notification. If the original complainant does not file a court action seeking an order against the subscriber within 10 to 14 business days of receiving the copy of the Counter-Notice, we may replace the removed material or cease disabling access to it.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Transcriptafy has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access of users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Service for any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
